Office Space Disputes
The time it may take to resolve the dispute. In general it takes significantly longer if the
matter is litigated which of course can have a direct impact on your ability to effectively
manage you business and will most likely have a significant impact on your ability to
properly administer what is most important - the profitability of your business
enterprise. The question I often ask in a dispute can I make more money by perhaps
giving the opposing party more money than I feel they deserve rather than spending
time and money fighting the dispute;

The emotional distress that inevitably follows when you are involved in a prolonged
and heated dispute; and

The implications for your long term relationship with the Landlord of your office space.

From my experience the first port of call is usually to call the operations manager of the
office building or the property manager who is responsible for dealing with disputes
regarding your office space. More often than not you will then need to put the basis of
your claim in writing.

When it comes to resolving disputes we believe in a very simple philosophy if the
opposing party is behaving nicely, you should reciprocate by behaving nicely in return.
If the opposing party is behaving badly you should respond accordingly unless the
issue is not significant and not worth the considerable effort involved in fighting a
dispute.

The difficulty for most people is that disputes are inevitably emotional especially
regarding your office space where a problem can be perceived to have an impact on
your ability to properly administer your business. However the most productive
method of attempting to resolve attempting to resolve the dispute is to remain calm at
all times assess the financial cost of the dispute to your business and do not escalate the
matter in terms of hiring solicitors and spending substantial sums of money unless one
of two things have happened:

Firstly the landlord has responded very aggressively or in a manner that is completely
contrary to the outcome you want or secondly the landlord has not responded in a
timely manner. (Keep in mind often disputes can be easily resolved with a simple phone
call and follow up email to the property manager).
